The owner of the tomato truck which was involved in a deadly accident with a Metro Mass bus on the Kintampo- Tamale Highway in the Brong-Ahafo Region which claimed over sixty lives has instituted legal action against the Metro Mass Company Limited at the Accra High Court for causing damages to his vehicle.
The plaintiff, Osman Alhassan who filed the suit at the Accra High Court on 2nd March 2016 is claiming damages from the Metro Mass Company for the negligent conduct of its decease driver which caused the fatal accident and resulted in his death (metro mass driver) and sixty one other persons as well as the destruction of his (plaintiff) truck with registration number AS1544-16 and all the 144 cartons of tomatoes and other goods it carried.
The suit said, the plaintiff bought and redesigned the truck recently at a total cost of GHc313,177.00 and still has a balance of GHc50,000 to be paid to one Kwabena Owusu Ansah, the owner.
It stated that, the truck earned him a weekly amount of GHc9,500.00 and on the day the unfortunate accident occurred, it was his fourth week in operation since he bought it.
The suit also stated that, the deceased driver disregarded traffic regulations by travelling with excessive speed beyond the accepted limit and failed to slow down when negotiating a sharp curve resulting in the accident.
The suit went further to state that, the negligent conduct of the deceased metro Mass driver has caused a colossal loss to the plaintiff and he is therefore by this suit praying the Court to award him general damages for the negligence of the defendant’s late employee which occassioned the loss to the plaintiff.
The damages include, a recovery of an amount of GHc13,177.00 being the total cost of the truck, interest of the said amount from february 17 to date of final payment and recovery of cedi equivalent of the amount of the CFA 15,000.00 and GHc2,500.00 which were cash amount lost as a result of the accident.
Again, the plaintiff according to the suit is praying the court to award him a damage of weekly income of GHc9,500.00 representing the lost income from february 17 to date of final payment, interest of the said amount covering the particular period, cost of legal fees and any other reliefs.
